Is anyone surprised that a president with no experience as an executive would be comfortable nominating a Supreme Court justice with no experience as a judge? And can we expect the same level of performance?

Former Justice Sandra Day O’Connor said Tuesday that she would not be surprised if fewer justices attended State of the Union addresses after President Obama criticized a recent Supreme Court ruling at this year’s address. She is the living embodiment of President Obama’s belief in “empathy” as the determining factor in jurisprudence, rather than the letter of the law. More to the point, she seems to feel that she will be inherently superior in her decision [...] President Obama has nominated Judge Sonia Sotomayor to replace Justice Souter on the US Supreme Court. He was quoted as saying he performed an “exhaustive” process before choosing her, despite the fact that she was the first name to emerge in speculation after Souter announced he would disappear back into well-deserved obscurity.
